How do we handle a divorce or khula case?
We start with a free first consultation, review the marriage contract and the facts, and identify the right route: divorce, khula, or judicial separation under the Omani Personal Status Law, Royal Decree 32/97 as amended. You get a frank assessment of your position and the likely outcomes before any case is filed.
In divorce proceedings the court invites reconciliation before deciding the dispute, and we represent you at that stage as well as at trial. In khula, the wife ends the marriage in return for compensation agreed with the husband or determined by the court. We draft the settlement or argue the case through to judgment and registration.
Our role does not end with the ruling. We follow up on enforcement of maintenance, custody and visitation orders, and we file modification claims when circumstances change.
Who gets custody of the children, and how is maintenance assessed?
Custody under Omani law is ordered around the child's best interest. On separation the mother has the first right of custody. As a general rule a woman's custody of a boy lasts until he completes seven years and of a girl until puberty, and the court may extend custody or rule otherwise where the child's interest requires it. We litigate custody claims, transfer and forfeiture, and we structure visitation rights.
Maintenance (nafaqa) is assessed by the court according to the payer's means and the dependant's needs, and covers food, clothing, housing, medical care and education. We prepare maintenance claims with full supporting documents, apply to increase or reduce awards when circumstances change, and follow through on enforcement.
How is inheritance divided in Oman?
Estates are divided according to the Islamic inheritance rules codified in the Personal Status Law, Royal Decree 32/97. The process starts with obtaining the heir determination deed, then inventorying the estate, settling its debts, giving effect to any valid will within its lawful limits, and distributing the shares among the heirs.
We handle amicable division where the heirs can agree, and litigate estate division claims where they cannot, including estates that hold real property and company shares. For non-Omani residents, questions of applicable law arise, and we address them in the first consultation.

How do I obtain an heir determination deed and divide an estate in Oman?
Division starts with obtaining the heir determination deed from the competent court. The estate is then inventoried, its debts are settled, any valid will is applied within its lawful limits, and the shares are distributed under the Personal Status Law. If the heirs agree, we complete and document an amicable division. If they do not, we litigate the division claim through judgment and enforcement.
