Marriage and Its Registration in Oman: Conditions and Procedures
Last updated: · SIA Law Firm
Marriage in Oman is a lawful contract governed by the Personal Status Law, Royal Decree 32/97, and its effect in official dealings is complete only when it is registered with the competent authorities. Skipping registration creates practical difficulties touching proof of the marriage, parentage, and financial rights. Said Ibrahim Ambusaidi Advocates (SIA), based in Al Khoudh, Muscat, handles marriage procedures, registration, and actions to prove marriage.
What are the elements and conditions of the marriage contract?
Under the Personal Status Law, the marriage contract is formed by offer and acceptance between the husband and the person contracting on behalf of the wife, in the presence of two witnesses, with the dower (mahr) named. The parties must have capacity, and there must be no lawful impediment — such as a prohibited degree of kinship or a subsisting waiting period — as detailed by the law. Consent is the essence of the contract: no marriage is valid under coercion, and each party may stipulate conditions that neither permit what is forbidden nor forbid what is permitted; recording these conditions in the contract preserves them in the event of a dispute.
The dower is the wife’s exclusive right, both its prompt and deferred portions, claimable as recorded in the contract. We therefore advise precision in drafting the dower particulars and any special conditions — many later personal-status disputes trace back to vagueness on the day of the contract.
How is a marriage registered, and why does it matter?
Marriage contracts are registered before the competent authorities in Oman — authorised celebrants and the courts — under the prescribed procedures. This ordinarily requires proof of the parties’ identities, the attendance of the guardian and two witnesses, and any approvals the law requires in particular cases: the marriage of an Omani man or woman to a foreigner requires the approval of the competent authorities before the contract.
Registration matters practically, not just formally: the official certificate is the proof of the marriage before every authority; with it the children’s documents are issued and marital and inheritance rights are established. An unregistered marriage forces the spouses into a court action to prove the marriage — with its evidence-taking and verification — which can become complicated if a spouse dies or a dispute arises.
What about residents and non-Muslims?
Non-Omani residents may conclude their marriage in the Sultanate under its prescribed procedures, or before their diplomatic missions as the case may be, then have it registered and legalised so it is recognised inside and outside Oman. Non-Muslims are subject to special rules that may apply the law of their community or nationality within the limits of Omani public order. Foreign documents — certificates of no impediment, prior divorce judgments — require certified translation into Arabic and legalisation through the proper channels.
We always advise checking in advance the recognition requirements in each party’s home country, so the couple is not surprised by a marriage valid in one country and unrecognised in another.

When to involve a lawyer
Involve a lawyer when preparing a marriage with a foreign element, to complete the approvals and legalisations before the contract rather than after; when drafting special conditions or financial arrangements between the spouses; and when you need to prove an unregistered marriage or correct the particulars of an existing certificate. The right procedure at the start saves long disputes at the end.
