Insult and Defamation in Oman: Penalties and Lawful Exceptions

Last updated: · SIA Law Firm

The Omani Penal Code, Royal Decree 7/2018, protects honour and reputation. It punishes defamation (qadhf) — attributing a specific fact that harms the victim’s honour — and insult (sabb) — abuse without attributing a fact — with penalties that scale by publicity and by who the victim is. Said Ibrahim Ambusaidi Advocates (SIA), based in Al Khoudh, Muscat, handles insult and defamation cases for both complainants and accused, including those arising on social media.

What are the penalties for insult and defamation?

The law distinguishes two degrees. Under Article 328, where the defamation or insult occurs face to face with the victim and without publicity, the penalty is imprisonment from ten days to three months and a fine from OMR 100 to 300, or either of them.

The penalty rises under Article 329 to imprisonment from one month to one year and a fine from OMR 300 to 1,000, or either, in cases including: where the act targets a public official during or because of the performance of their duties; where it touches honour or damages reputation; or where it is committed by way of publication in newspapers, printed matter, or other media. Publication on the internet and social media platforms falls within this aggravation, and where an information network is used, the facts may also engage the Cybercrime Law, with the Prosecution applying the graver characterisation.

When is the act not punishable?

Article 333 sets out important lawful exceptions. There is no punishment where: the author proves the truth of the fact attributed, provided it was directed at a public official and connected to the office; a report is made in good faith to judicial or administrative authorities about a matter warranting its perpetrator’s accountability; or the statements are made in the parties’ oral or written defence before courts or investigation authorities, within the limits required by the right of defence.

So someone who reports a suspected crime to the police or the Prosecution in good faith is not a defamer even if the investigation is closed, and a lawyer’s pleading within the bounds of defence is protected. Fabricating reports known to be false, however, is a separate offence in its own right.

How does the case proceed in practice?

Insult and defamation cases generally require the victim’s complaint to set the case in motion, subject to the complaint window in Article 5 of the Law of Criminal Procedure RD 97/99: three months from learning of the offence and its perpetrator. Proof turns on documentation: authenticated screenshots, testimony of those who saw the post or heard the words, and, where the account must be linked to its owner, reports of the competent authorities.

Alongside the criminal case, the victim may claim civil compensation for moral and material harm, either as a civil claimant within the criminal proceedings or by a separate civil action.

When to involve a lawyer

If you face a smear campaign or abusive posts, speed matters: documenting the content before it is deleted and filing the complaint within its window are the foundation of the case. If you are the one accused, the lawful exceptions — good faith, the right of defence, proof of truth in its permitted cases — can end the accusation entirely, and they must be raised properly from the investigation stage.
