Annulment and Enforcement of Arbitral Awards in Oman
Last updated: · SIA Law Firm
The issue of an arbitral award is not the end of the journey. The losing party has a narrow window for an annulment action on exhaustive grounds, and the winning party has a disciplined route to an enforcement order — all under the Law of Arbitration in Civil and Commercial Disputes, Royal Decree 47/97. Said Ibrahim Ambusaidi Advocates (SIA), based in Al Khoudh, Muscat, handles annulment actions and applications to enforce arbitral awards.
When is the annulment action brought, and on what grounds?
Arbitral awards are not subject to the ordinary routes of challenge available against court judgments. The law instead permits an annulment action in exhaustive cases, including: the absence, nullity, or voidability of the arbitration agreement; the incapacity of one of its parties; violation of the right of defence through defective notification or inability to present one’s case; the award exceeding the scope of the agreement; the tribunal’s composition or the procedures contradicting the parties’ agreement or the law; and the award’s conflict with public order in the Sultanate.
The deadline is decisive: Article 54 of the Arbitration Law provides that the annulment action must be brought within the ninety days following notification of the award to the party against whom it was rendered, and a waiver of the right to bring the action made before the award issues does not bar its admission. The competent circuit hears the action as the law prescribes.
Does the annulment action stay enforcement?
Not by operation of law. Under Article 57, bringing the annulment action does not stay enforcement of the award; the court may, however, order a stay if the claimant requests it in the statement of claim and the request rests on serious grounds. The court must decide the stay request within sixty days, may condition a stay on a bond or financial guarantee, and must then decide the annulment action itself within six months of the stay order.
The balance is deliberate: the winning party is not deprived of the fruit of the award by a vexatious action, and a defective award is not enforced without scrutiny.
How is the award enforced?
Article 55 provides that arbitral awards rendered in accordance with the law have the authority of res judicata and are enforceable. The enforcement application is submitted, under Article 56, to the president of the competent court or their delegate, accompanied by: the original award or a signed copy; a copy of the arbitration agreement; a certified Arabic translation if the award was not rendered in Arabic; and proof of the award’s deposit.
Under Article 58, the award may not be enforced before the annulment window has expired, and only after verifying that it does not conflict with a judgment previously rendered by the courts on the subject of the dispute, does not violate public order in the Sultanate, and was properly notified to the losing party. Foreign arbitral awards are enforced under the international conventions in force, including the New York Convention.
Key facts
- Arbitral awards are immune from ordinary challenge; only an annulment action on exhaustive grounds lies, under the Arbitration Law RD 47/97.
- The annulment action must be brought within ninety days of notification of the award, under Article 54.
- Bringing the action does not stay enforcement; the court may stay on serious grounds and must decide the stay within sixty days, under Article 57.
- The award has res judicata force and is enforceable, under Article 55.
- The enforcement order issues from the president of the competent court on the documents listed in Article 56.
- No enforcement before the annulment window expires, and only after checking public order and proper notification, under Article 58.
When to involve a lawyer
If an award has been issued against you and you believe it is defective, you have only ninety days to build a serious annulment action on disciplined grounds — and a reasoned stay request beside it. If the award is in your favour, moving quickly to assemble the enforcement documents and obtain the order cuts off your opponent’s stalling room, and you may need to enforce the award outside Oman through the international conventions.
At Said Ibrahim Ambusaidi Advocates (SIA) we handle both sides of the post-award stage: annulment actions and stay requests, and enforcement applications with compulsory recovery inside and outside the Sultanate.
